Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in federal custody.
In her order, the court pointed out that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Background of the Case
The legal challenge involve conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
