Alina Habba has left her position as the chief federal prosecutor in the state. This follows a judicial decision that invalidated her eligibility to occupy the role.
Acceptance of Resignation
The head of the Justice Department, the Attorney General, announced Habba's resignation on Monday. Bondi stated that the appeals court finding made it "untenable" for the official to lead the department effectively.
"Let no one confuse following the order as giving up," Habba stated. "The effort will now reach across America."
Judicial Challenge
Her resignation was triggered by a judicial panel found that she had been acting without proper authority as the top prosecutor. This ruling is likely to affect many criminal cases in the Garden State.
The appellate judges said that a acting appointment that did not receive Senate approval ran afoul of the Federal Vacancies Reform Act.
Ongoing Legal Battle
The Attorney General added that she will continue working within the Department of Justice as a high-level advisor. They intend to challenge the decision of the disqualification, with hopes of a different outcome.
On a social media platform, the Attorney General wrote that the judiciary "must not countermand the President's choice of prosecutors responsible for carrying out the fundamental role of the presidency of prosecuting crime."
Performance in Office
She praised Habba's record and pointed out that while she was in charge, the city of Newark saw a significant drop in criminal activity. It was also reported that the southern city of Camden experienced its initial homicide-free summer since 1974 free from homicides.
Legal Career
Habba, was initially recruited to the former president's legal defense in recent years. She went on to represented her client in his New York criminal case in the previous year, leading to his conviction on 34 counts of falsifying business records.
Prior to Habba took on the top New Jersey post, Donald Trump had stated he was appointing her as his senior adviser during his second administration, describing the lawyer as a steadfast ally and a dedicated fighter for justice.
